According to an announcement made by the company in the Singapore Exchange (SGX), the restraining order and permission to call for the creditors’ meetings were granted by the Melaka High Court on Friday.
The nine respondents named in the forfeiture case are Kuala Dimensi Sdn Bhd (KDSB), who is the main contractor of the PKFZ project, along with Transhipment Megahub Bhd, Coastal Skyline Sdn Bhd, Wijaya Baru Aviation Sdn Bhd, Wijaya Baru Sdn Bhd, Wijaya Baru Construction Sdn Bhd, Bintulu MP Datuk Seri Tiong King Sing, Law Ka Hieng and Selangor Development Corporation (PKNS).
Penang-based Wabina Constructions & Engineering Sdn Bhd will have the full merits of its application over its legal challenge of a government decision that effectively exempts all companies in debt from having to pay its creditors for six months following the Movement Control Order, which was implemented to curb the spread of Covid-19.
The decision was made by Justice Mohamed Zaini Mazlan after hearing submissions from all parties today.
The family's lawyers Sangeet Kaur Deo and Ramkarpal Singh said this after meeting with Court of Appeal judge Datuk Vazeer Alam Mydin Meera, who will preside over the trial despite his elevation to the appellate court.
The panel of judges comprises Court of Appeal judges Datuk Yaacob Md Sam and Datuk Hadhariah Syed Ismail besides High Court judge Datuk Wira Ahmad Nasfy Yasin.
