PETALING JAYA (June 6): Infraharta Holdings Bhd's efforts to enforce an adjudication award and costs totalling RM4.59 million against Sheng Tai Impression Sdn Bhd (STISB) are now subject to restrictions under a statutory moratorium, following the filing of a Judicial Management (JM) application by STISB.
Separately, a wholly-owned subsidiary is defending a recent RM600,032 adjudication claim arising from a road infrastructure project in Negeri Sembilan.
Recovery action paused by JM application
In a Bursa filing yesterday, Infraharta mentioned that further details of the adjudication award against STISB were disclosed in the company's April 2, 2026 Bursa announcement, relating to a construction contract for a project in Daerah Melaka Tengah, Melaka. On March 31, 2026, the Adjudicator determined the adjudication in favour of Infraharta Sdn Bhd (ISB), a wholly-owned subsidiary of IHB, with the decision communicated to ISB's legal representatives on April 1, 2026.
Under the award, STISB was ordered to pay ISB a principal adjudicated sum of RM4,481,890.66, together with adjudication costs of RM110,702.00 — both due by April 14, 2026.
STISB was also directed to pay interest at 5% per annum on the awarded sums across three tranches: on RM3,314,975.87 from their respective due dates, on RM1,091,632.71 from Jan 24, 2025, and on RM75,282.08 from Feb 7, 2025 — all accruing until full and final settlement is made on each respective item.
Following non-payment of the adjudicated sum, ISB served a Winding Up Notice on May 14, 2026, under Section 466(1)(a) of the Companies Act 2016, giving STISB 21 days to settle the outstanding amount.
On June 3, 2026 — one day before the deadline lapsed — STISB filed a JM Application at the High Court of Shah Alam, which in turn activates a statutory moratorium restricting creditors, including ISB, from continuing or commencing certain legal proceedings against STISB without leave of court while the JM application is pending.
The hearing is expected to be fixed within 60 days of filing. Infraharta said it will take all necessary legal steps to protect its position.
Road project in Negeri Sembilan
On a separate front, Infraharta Bina Sdn Bhd (IBSB), another wholly-owned subsidiary of IHB, was served a Notice of Adjudication by Chung Nyap Yoon Sdn Bhd (CNYSB) on January 20, 2026, for a total claim of RM600,032.08.
The dispute centres on a road infrastructure project — "Membina Jalan Baru Menyambung Felda Bukit Jalor ke Gemas, Negeri Sembilan" — where CNYSB was appointed as sub-contractor to carry out site clearing, earthworks, pavement works up to roadbase, environmental protection, and routine maintenance.
CNYSB's claim comprises two components: RM15,437.50 representing the outstanding certified sum under Progress Payment Certificate No. 18 dated Dec 7, 2023, and RM584,594.58 for the outstanding uncertified sum under a Final Progress Claim submitted on June 25, 2025, together with interest at 5% per annum from the respective due dates and all costs incurred in the CIPAA proceedings.
The adjudication, registered as AIAC/D/ADJ-6414-2026, has since progressed with the appointment of Ho Kin Wing as adjudicator, who accepted his appointment on May 11, 2026 and issued procedural directions shortly after.
Infraharta said it has a defence to the claim and does not expect it to have a material financial or operational impact for the financial year ending June 30, 2026. IBSB is not a major subsidiary of IHB.
Infraharta will make further Bursa announcements as material developments arise in both proceedings.
