PETALING JAYA (Aug 11): Lim Seong Hai Capital Bhd said the Court of Appeal has allowed two appeals by Hydroshoppe Sdn Bhd and Menara Kuala Lumpur Sdn Bhd, resulting in three of the group's units again becoming parties to the legal dispute over KL Tower.
In a Bursa Malaysia filing on Monday (Aug 10), LSH Capital said the appellate court allowed the plaintiffs' appeal against the High Court's July 15, 2025 decision striking out their writ and statement of claim against LSH Service Master Sdn Bhd, LSH Best Builders Sdn Bhd and Service Master (M) Sdn Bhd (SMSB).
The Court of Appeal also allowed the plaintiffs' appeal against the High Court's dismissal of their application to amend the writ and statement of claim, the group said.
As a result, LSH Service Master, LSH Best Builders and SMSB will again be parties to the suit, which is scheduled for trial at the High Court from June 28 to July 2, 2027.
LSH Capital said vacant possession of KL Tower was delivered by the Government of Malaysia to LSH Service Master on April 19, 2025, and that the unit has operated and managed the tower since April 26, 2025.
The group said the ongoing litigation is not expected to materially affect LSH Service Master's rights, business or operations at KL Tower under the concession agreement dated March 10, 2025. It said further announcements will be made if there are material developments.
